Should Susie Smythe Be Sued?
Susie Smythe, a high school teacher from New York, reads a class-sourced novel called The Absolutely Awesome Adventures of Internet Ed. She decides to copy the plot, and even plagiarizes a chapter, within her own classroom’s book called The Mind-Blowing Travels of Fairuse Frieda. Consequently, she sells the book on amazon.com, with no acknowledgement of the original authors or inspiration, and donates all the profits to her school’s non-profit organization. Using the research and point of view of various sources from Stanford University, Plagiarism Today, and Pearson Writing Center, the suing of Susie Smythe would not be necessary for this particular situation. The concepts of fair-use and copy infringement have contributed to this decision.
Due to the definition of fair use, Mr.Rehak has no right to sue Susie Smythe. Judgement on deciding whether a case is “fair use” or not uses the four factors listed in section 107 of the Copyright Act (Teaching Copyright). One of the factors that judges will take into account is whether or not the new work is for commercial use. Here, Susie Smythe, is not using the new book for commercial uses but rather donates any profits to her non-profit school (Pearson). Another factor to take into account is the amount that was taken from the original copy in relation to the whole new book. She does in fact take one, word by word copy of the chapter of the original but, in comparison to the whole book, it’s really not a big amount. Copying nearly all of the original book would weigh against her use of fair use, but since she only used one chapter of twenty-two, she really has nothing against her. The most evident factor to be taken into

consideration is, what effect of the use of the original book’s idea has on the potential market. Since she has not ‘replaced’ the original book from the market with her version, she has no reason to be sued.
It could be argued that since Susie Smythe copied the plot and plagiarized a complete chapter from the novel therefore, it was not fair use. Susie Smythe used a chapter, word for word, from the novel The Absolutely Awesome Adventures of Internet Ed. Her only edit was changing the name Ed to Freida. Susie gave no recognition to the original author, which clarifies her act as plagiarism. According to Plagiarism Today, “Plagiarizing works in the public domain, though unethical, is not considered copyright infringement.” Thus not requiring legal action. It could also be argued that since Susie Smythe ripped off an entire chapter her use was not fair. However, she used the chapter and the book as a whole for a nonprofit educational purpose. In an article written by Jonathan Bailey, it is stated that “if the material was used for nonprofit educational purposes, it is fair use” (Plagiarism Today). This is apparent in Susie Smythe’s situation. The money earned from the book was all donated to her school’s non-profit organization.
It is clear that there are no solid grounds on which to sue Susie Smythe. The evidence shows that Susie Smythe donated the profits from the book to her non-profit school, concluding that it was not used for commercial purposes. It also shows that she plagiarized a very small portion of the book, only one chapter. It has been clearly stated that plagiarism is not considered copyright infringement. Since the evidence does not provide reasons of advantage to take legal action, Mr. Rehak deems it unnecessary to sue Susie Smythe.

A Week to Remember: Week 24
Ello. Omgg, only two more weeks of school. This week has been okay. It went by very sloly. In gym we're playing volleyball, and my team made it to the semi-finals. I think we have to win against two more teams to win the championship. Playing volleyball in gym made me realize how much I missed playing volleyball. I had a wonderful time at the zoo. It had been such a long time since I went. I saw a giant goat, an ape fight, and a giraffe. I was disappointed because there was no organgatane out. They are so adorable. I am a big fan of the oragatane in Planet of the Apes. And I met a pig and named him curly. It was great just getting a break from school, while learning.

Hello people of the world. This week has been okay. Yesterday I went to a conference and we discussed entrepreneurship and social media. It was amazing. I was able to meet some powerful women in the field of accounting. However, the actually days spent in school were not as appealing because we had to take Plan, the pre ACT. Hello blogviewers, this week has been very chill and calm. We went to the zoo on Monday. I think that was the first time I went in 3 years. Oh, also I saw an ape fight. It was scaring. A Week to Remember: Week 17
Hello world and all it's inhabitants. Thus week has been very tiring. I got from Ohio and I had a fun time. We had a tournament there for chess. I did okay. I won 2 out of 7 games. Boy was it hard. Anyway I currently in the act of making jewelry to sell at a fashion show we are hosting at my job. My jewelry is looking awesome at the moment, if I care to say so myself. That great thing about jewelry making is that I will no longer have to worry about finding gifts for Christmas, Birthdays, and more. School is okay at the moment. Ello, blog viewers. I am sadden to inform you that I am not completely able to swim. However, I have an excuse. We are only given 3 days out of the week to swim and I had to miss one of those days because I was sick. We only have 3 days because the freshman had to take the PARCC test and so our schedule had been adjusted to accommodate this test. I am most definitely against standardized testing. I do not believe this testing method is an accurate measurement of ones skill nor intelligence. Down with testing. I am more than a test score. That's all for now. Catch you next week. WYChat: How to move the pieces in chess

Hello, my name is Kiana Hobbs. I am a sophomore here at Whitney Young and today I will teaching you how to move the pieces in chess.
So first I will just give you so background knowledge on the game of chess. It is assumed that chess has been around since the 15th century. Chess is strategic game played between to people, who compete against each other to checkmate their opponents’ king. A chessboard contains 64 squares. An 8x8 square, with one side ranging from 1 to 8 and the adjacent side ranging from A to H. Each player receives 16 pieces: 1 King, 1 queen, 2 rooks, 2 bishops, 2 Knights, and 8 pawns. The objective of this game is to checkmate your opponent. Checkmate occurs when the king is being attack, which is a check, but he can not move anywhere, which makes it a checkmate.
Now that you know that stuff let us get to the identities of these pieces. First we will begin with this (show pawn). This is a pawn. It is worth 1 point. Points are not used to determine the winner of a game, but to indicate who may be leading in the game with. Even though a person may be have less pieces than there opponent, they can still win if they try hard enough. So a pawn only moves forward one space on it’s move. However on the pawn’s first move it can either move one or two spaces. That's only on the first move of that particular pawn. A pawn may only move forward, never backwards or side to side. But it only attacks diagonally ( show how it attacks diagonally). Weird, right? So what that means is that if a pawn is here and my pawn is here, I can take this pawn if it is my move ( set up position show pawn taking other pawn). If the pawns are like this ( pawns face to face), you are stuck. No piece can jump over another, with the exception of the knight. So since the pawn can only move forward and take diagonally. Neither pawn can move. The only way either pawn will be able to move is if the other pawn is taken by another piece. Pawns are very powerful pieces. If by chance your pawn makes it to the end of the board, you may exchange that pawn for a different piece, with the exception of another pawn or a king.
And that's all for now about pawns, next is a bishop. A bishop is worth 3 points. Bishops move diagonally along the color they are on. They can move as far as they want, as long as there is no piece blocking their path (show bishop moving). The bishop’s movement is pretty simple so next we will go to the knight. A knight is also worth 3 points. It move in a “L” shape, that encompass 3 squares (show L shapes). It can go 2 then 1 or 1 then 2. A knight is the only piece that can jump over another piece. See ( show knight jumping over piece). So now you try to get from here to here in two moves. Did you get it. You could have either chosen this or this or that. Just remember if your knight is positioned in the center or near it, you should have 8 possible spaces to land on, so look closely ( show the 8 moves). So let's try one more. How many moves does it take you to get from here to here? (Wait 6 seconds and show correct answers). The next piece is a rook. Rooks are worth 5 points. The move horizontally and vertically. They can move as far as they would like as long as there is not blocking their path (show rook movement). Then comes the queen. Queens are worth 9 points. They can move horizontally,vertically, and diagonally. So the queen has the moves of both the rook and the bishop, not the knight. The Queen can move as far as it would like, as long as there is nothing blocking it's way (show queen’s movement). One more piece to go. Last but not least it the king. The king is priceless. If you lose the king, you lose the game. Kings can only move one space in any direction. They have no fancy moves, which is way they have to be protected by the other pieces.

A Week to Remember: Week 14
Hello, blog viewers. This has been a good week. I'M ALMOST SWIMMING!! It's so amazing I'm slowly but steadily learning how to swim. I know how to front float, back float, bob, kick, and kinda use my arms now. Now all I have to do is put it all together and I will be swimming in no time. Hopefully by my next blog I will be posting "I CAN SWIM NOW". Fingers crossed. Other than that this week was fine. I got an "A" on my trigonometry quiz. Which is a plus. But now we are going over how to graph sine and cosine, which is a bit confusing. However I did some research and I feel more confident on the subject. We have a quiz next week, so wish me luck. A Week to Remember: Week 13
¡Hola! It has been a good week this week. We've started swimming in gym last Monday, and I am excited about it. I believe this is my year to learn how to swim. Last year my swimming teacher told the people in the shallow end to swim from one end to the other. Does that make sense to you? Well, not to me. Long story short I didn't learn how to swim. A Week to Remember: Week 12
Hello world. It has been a good week. On Monday I could not attend school because I was sick and on Tuesday only Juniors had to go to take the ACT. But that's not the only reason why it was a good week. At work we are making an earring and necklace set in groups. So far my group is doing really well. We sculpted our beads out of green and yellow clay. Our theme is flowers in bloom. The name of the brand is Spring Heat. I came up with that name. It's an awesome, I know. A Week to Remember: Week 10
This week has been "chill". Haha, chill. You get it. Because it was cold. If you're in Chicago you'll understand. So the tournament ended last Saturday and we did very well. We finished 13th place out of 144 teams. I was able to win five out of six my games. It was very exciting but next year we will be taking home the first place championship.Also I started to read a book for book club named "Graceling". Thus far it is a good book. It's fairly interesting. You should read it. It is In the genre of sci-fi. That will be all for today. This is Kiana signing out. Peace.

A Week to Remember: Week 9
Hello world. I know it's early for the end of the week review, but I have a tournament and I don't want to forget to do it. So this week we have state for chess. I'm excited. We leave for Peoria tomorrow. At work I finished my necklace. It's orange and blue. We had to make a double layered necklace. Mine has 3 wires and they are weaved together. It's beauuuutiful. You have to say it while adding emphasis on the "u". I think I did great for my first creation. I feel accomplish. At work we were asked the question "How often do you complain?". I try not to complain about materialistic items, since of course there are people less fortunate than me. When I complain it's usually out of laziness because things be "sooooo far". So this week has been pretty chill. I got a job. It's with After School Matters. I will be creating my own jewelry. For my first piece of jewelry, I'm going to create a double layered necklace with blue and gold gems. And it's going to be beautiful. Next week we have state in chess. It is going to be in Peoria. Internet Ed
For my internet Ed
adventure, Ed will become Aliyah. Aliyah is a female contestant on the show
Survivor. They are at a point in the season where the tribes, Hunahpu and
Coyopa, have just dissembled, leaving all the contestants at risk of
elimination. Aliyah knows that if she does not win the next immunity challenge
or find an idol she’ll be the next to go. Aliyah had lied about Tim wanting to
get George out, which led to Tim elimination last tribal council. Now her head
is on the chopping block.
“Well, that was an
interesting council”, said Ed as Aliyah, she hide her excitement for the
elimination of Tim. It was either him or her and with her great manipulation of
the others it ended up being him.
“Yeah, didn't see that
one coming”, mumbled Sabrina, aware of Aliyah’s part in Tim’s elimination. It
was her plan to eliminate Aliyah, but since George changed targets the plan
could not be carried out. “Guess you saved yourself this council…. But I don’t
think you’ll be as lucky next tribal” warned Sabrina.
Sabrina and Aliyah rival
begun near the beginning of the season. Both Sabrina and Aliyah were on the
Coyopa tribe and they were doing well, the best of friends who just meet. But
that all changed when at one challenge, Aliyah purposely did poorly in the
challenge in an effort to make her team lose. She had heard through rumors that
Sabrina was planning to get her out, so she wanted to act first. It had turned
out that the rumor of Sabrina wanting to get Aliyah out was just that a rumor.
And that’s how their rivalry begun.
Determined not to be
eliminate Aliyah set out to look for an idol. Aliyah stumbled upon a tree that
look suspicious.
“Hmm… Nice try producer,
you should try a little harder at hiding these things”, Aliyah thought to
herself.
Aliyah had begun to dig
near the tree. She dug and dug and dug and dug. But found nothing. Ed couldn't help but laugh at this humorous and desperate woman. Half an hour passed with
no sign of an immunity idol. Aliyah went back to camp. Ed knew Aliyah had no
chance of remaining on the island without the idol, so he was ready to go. Ed
reached into Aliyah’s pocket for her cell phone, but comes out empty handed. He
would realize that Aliyah doesn't have a phone. “No one has a phone on this show”, Ed muttered to himself. Fear arose in Ed at this realization. As night
approached, Ed fell into a deep slumber. The next day Aliyah still had no luck
in finding an idol and Ed had no chance in finding a phone. Both were hopeless
in their pursuit, until it was time for reward challenge. By some unexpected
coincidence the reward for this challenge was a phone call to a love one. Ed
could not believe his luck. Now all he had to do was win the challenge and the
phone was all his.
“For this challenge you
will all have to swim from this dock to the beach. When there, you will have to
drag a bag of puzzle pieces up to a bench. From there you’ll solve a puzzle.
The first to finish will win the reward”, said Jeff, the host of the show. “Get
into your ready position and we will begin.”
“It so sad your time here
has to come to an end, but you know the show’s backstabber never wins” hissed
Sabrina at Aliyah. “And another thing, just try not to drown”.
Aliyah rolled her eyes
and focused on the water. Aliyah knew she was a terrible swimmer and the others
did to after she caused her tribe to lose when she tried to swim fast but
failed miserably. Jeff shouted go and everyone was off. Aliyah took off
swimming slowing but steadily. Ed was no help since he spent most of his time
programming rather than swimming. Sabrina and the others arrived at the beach,
but Aliyah still had about 6 feet to go. Aliyah finally arrived at the beach and
dragged the puzzle pieces to the bench.
Even though Aliyah was about 3 minutes behind the others, none of the
other contestants, with the exception of Sabrina, had made any progress on the
puzzle. Sabrina was well on her way. She was half way through with the puzzle.
Aliyah took out the puzzle and it made absolutely no sense to her. But Ed, he understood
the puzzle. He had seen the same pattern when he was programming one day. Ed
took control of Aliyah and solved the puzzle in a blink of an eye. The other contestants gaped in astonishment. Sabrina’s face was priceless.
“That was a piece of
cake, where’s the entrée?”, Aliyah said with a smirk.
“You’re still going
home”, threaten Sabrina.
Aliyah forgot that this
was not an immunity challenge. She only won a phone call, not an idol.
“Congratulations Aliyah you've won a call home.” said Jeff.
“Yay” Aliyah said dryly,
with sarcasm.
“Aliyah I’m going to make
you an offer”, said Jeff. “You can either take the phone or make the phone call
or you can get an immunity idol”.
Before Aliyah could
answer Ed reached for the phone and entered in "control, shift, command,
42, meaning of life, J,K,J,K, J,K,R, control, command, option escape,
escape" and before entering in the last escape Ed said.
“I’m sorry, not sorry”,
said Ed and he entered “escape” and left.
A Week to Remember: Week 7
It has been a good week this week. We had finals this week. And now they are over!!!! Celebration time. On the first day of finals I had Trigonometry, Driver's Education, and World Studies. Trigonometry was okay and was not that painful. Driver's Education was not hard actually. I believe I'm ready for the road. Now I just have to take range and traffic. World Studies was kind of difficult, but I refused to stress out over my exams. The next day I had lunch, English, and Chemistry. That was a nice and calm day. On the last day I only had 2 classes: Choir and Spanish. I had my singing final on Friday and I was nervous. However my teacher said I did well and I passed. And that was my week for you. A Week to Remember: Week 6
It has been a good week this week. On Monday, we had no school. This was because of Dr. Martin Luther King. I will just like to take the time and thank Dr. Martin Luther King for his amazing dream. Life would not be as it is today. Was it not for his bravery and commitment to unity, who knows what life would be like, what opportunities I would have, they places I will be able to go. So for this weekly review I would like to post a poem I wrote in 5th grade in honor of Dr. Martin Luther King Jr.

A Week to Remember: Week 3
Post for the week of winter break. The week is finally over and winter break is here. This week has lacked enjoyment since I had to rush and make up assignments I missed during my time in Florida. I had to makeup a Driver's Ed, Trigonometry, and Spanish test this week. However in Choir we watched The Temptations and it was amazing. I developed a fondness for them after watching the movie. A Week to Remember: Week 5
This week has been mild. Nothing exciting or jaw dropping happened. I had a chess tournament yesterday and I went 2 and 2. In choir we are singing a Motown mashup. It includes the songs: Dancing in the Streets, I Heard it Through the Grapevine, Ain't No Mountain High High Enough, What Becomes of the Broken Hearted, I Can't Help Myself, Back in My Arms Again, and Reach out, I'll Be There. I'm so excited to perform these songs because we'll be dancing as well. So I'll be able to bust out my great dancing moves. So that was my week for you guys. This is Kiana signing out. Peace

A week to remember: Week 4
This week has been very cold in the Windy City. That is the worst part about living in Chicago, the weather. Any way I've been sick for the past couple of weeks , so I wasn't able to enjoy my week as I would've liked to. But aside from that it has been good. My sister finally had her baby about 2 weeks ago. It's a boy and all he does is sleep. Lucky, though, he's not a cry baby. Which is great. This will conclude my journal of the week. This is Kiana signing out. Peace.
